Terms and Conditions of Trading with Living Art

Our Terms and Conditions apply to all transactions on the Living Art website and are set out below. Please read through these carefully before placing your order and then print a copy for future reference. Please also read our 'Data Protection' Policy regarding personal information provided by you.

1. We may change these terms from time to time without notice to you. Changes will apply to any subsequent order received.

2. Delivery can only be made to mainland UK & Northern Ireland addresses. We cannot deliver overseas, to the Channel Islands, BFPO addresses, or the Republic of Ireland. All goods must be signed for by an adult aged 18 years on delivery.

3. Delivery charges and estimated timescales are specified in the 'Delivery' section.
We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable.

4. Goods are subject to availability. In the event that we are unable to supply goods, we will inform you as soon as possible. A full refund will be given where you have already paid for the goods.

5. The price you pay is the price displayed on this website at the time we receive your order apart from the following exception. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of the goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you have already paid for the goods, you will receive a full refund.

6. We do file details of your order. Please read our 'Data Protection Policy' for details of how these can be obtained

7. Payment can be made by any method specified in the 'Payment Options' section. We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

8. The laws of England and Wales shall govern the contract between us and any dispute between us will be resolved exclusively in the courts of England and Wales. English is the only language offered for the conclusion of the contract.

9. In the unlikely event that you receive faulty or damaged goods, please ask for our 'Returns and Refunds' policy. This does not affect your statutory rights.

10. Where applicable, you may cancel your order in accordance with your rights under the Distance Selling Regulations, please see the full details in our 'Cancellations (UK Distance Selling Regulations)' section. We do try to make sure details contained within the site are as accurate as possible. On the rare occasion that there is an error, we will advise you about it as soon as possible.

11. We do not guarantee that this website will be compatible with your PC and we accept no liability for any corruption or loss of data held on your PC, or any liability for any other loss or damage of any kind caused to your PC resulting from the use of this website.

12. Cancellation & Returns
12.1 You may cancel your order by giving us notice of cancellation within 30 days of the date of collection or delivery. Such notice may be given by mailing, faxing or emailing to the number or address set out on the order form. If you are cancelling because of any problem with the goods, please notify us of the problem at the time of cancellation.

12.2 On cancellation for whatever reason, you must return the goods to us at your cost unless the goods are being returned because they are faulty, incorrect goods or because of unsuitable substitution by us, in which case we will meet the cost of return but we ask that you allow us to nominate the carrier.

13. Force Majeure
We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).
